A 2017 Rutherford County Court Case involving the dismissal of an attempted first-degree murder charge in exchange for a guilty plea to aggravated assault is back in the courts.

Sara Elizabeth Arnold was indicted in the courtroom of Judge Royce Taylor for the attempted murder of her roommate in 2017. The original court records indicate the attempted murder stemmed from an attack with a knife.

After pleading guilty to aggravated assault, she accepted an eight-year prison sentence with a 30% release eligibility date. Her sentence officially ends in year 2024 and she will have a parole hearing in just a few days on May 21, 2019.

Despite her nearing parole hearing, Arnold filed for post-conviction relief alleging that her guilty plea was not knowingly and voluntarily entered due to her mental incompetence. Arnold also suggested her trial counsel failed to properly have her mental state evaluated.

The woman, who is now 26 and the Court of Criminal Appeals has since ordered for the case to be reviewed for further proceedings pertaining to the petition.
