Couple asks for felony murder charges to be dismissed - Denied

Terry Craighead and Sinead St. Omer, who were charged with felony murder in Rutherford County, are asking for the case to be dismissed. The couple was accused in the death of their 5-month old daughter in 2013.

The two claim they should not have been charged and that the investigation was not complete.

According to court documents, "The Defendants maintained that the information stored in the feeding pump would have established that they did not deprive the victim of nutrition as alleged by the State." They suggested the child died of natural causes and the states failure to collect the feeding tube led to the rightful outcome of the investigation.

The case was investigated in LaVergne, Tennessee where the child lived in a motel room with Craighead and Omer. Court documents showed, "The room was disorganized and not clean and that alcohol bottles were in the room." DCS was called as police photographed the room failing to take the feeding tube as evidence.

Despite request for the charges to be dropped, The Tennessee Supreme Court denied the case from moving forward.

During one court hearing about the charges, the state argued that the feeding tube apparatus did not have to be collected.
