Murfreesboro Police met with a convicted Sex Offender at a South Church Street hotel and suggest he had a warrant for "Tampering with an Electronic Monitoring Device."

A police report showed that Phillip Sparks stated, "He had rented the room today because he thought the Select Inn was more than 1,000 feet away from a school." However, officers found that his rented room was within 1,000 feet of the Rutherford Academy on Southgate Boulevard several thousand feet behind the hotel.

Rutherford Academy is a private school for special needs children in grades 1^st through 12th. The school has been in operation for over 17 years. The school serves students that are identified with emotional and psychiatric disorders, learning disabilities, intellectual disabilities, autism spectrum disorder, dual-diagnosis, and/or developmental delays.

Due to Sparks past victim being a minor, he is not allowed to live within 1,000 feet of a school. Sparks was convicted in 2009 of "Sexual Battery of a Minor" in Davidson County. He was also convicted on November 15, 2018 of "Exploitation of a Minor by Electronic Means" in Davidson County.

The sex offender was charged with "Violation of Residential Restrictions" and served the active warrant for tampering with an electronic device.
